On April 10, 2018, the Lawyers’ Committee for 9/11 Inquiry (www.lcfor911.org) filed a 52-page petition with the U. S. Attorney for the Southern District of New York, Geoffrey Berman.
The petition requests that Berman present to a special grand jury the extensive evidence of unprosecuted federal crimes related to the destruction of three World Trade Center Towers (WTC 1, 2, and 7) on September 11, 2001. The petition contains 57 exhibits with evidence that explosives were used to destroy the three buildings.
The evidence presented includes scientific analysis of WTC dust samples; eyewitness testimony from first responders; scientific analysis from architects, engineers, chemists, and physicists; and seismic evidence demonstrating that explosions occurred in the buildings prior to airplane impacts.
According to Mick Harrison, Director of Litigation for the Lawyers’ Committee, federal statute requires that the U.S. Department of Justice pass on citizen reports of federal crimes to a special grand jury. Such grand juries have broad powers to investigate crimes and return indictments for prosecution.
What Happens Next?
If U.S. Attorney Berman chooses not to present the evidence to a grand jury, the Lawyers’ Committee will consider bringing a mandamus action in federal court. A mandamus action is a lawsuit that could be used to compel the U.S. Attorney to fulfill his legal duty and submit the evidence to a special grand jury.
According to Harrison, the U.S. Attorney has no legal obligation to notify the Lawyers’ Committee of his decision. However, the group plans to allow a “reasonable time” of 60 to 90 days for Berman to respond before pursuing further action.
